What is the Purchase Process?
Once the offer is accepted, the notary drafts the preliminary sales agreement. This document formalizes the agreement between the parties on "the property and the price" and typically takes 30 to 45 days. Upon signing this agreement, the buyer places a security deposit, generally 10% of the purchase price, into the notary's escrow account.
The notary then has about three months to carry out the necessary legal verifications (liens, mortgage, clearing titles, pre-emption rights, etc.) before preparing the final deed of sale. You become the official owner upon signing this deed, with the remaining balance and notary fees paid prior to closing. Generally, it takes between 4 to 6 months to complete a property purchase in Saint-Barth.

For the Seller:
• Agency fees
• Mandatory inspections
• Fees for an accredited tax representative, if necessary
• Potential capital gains tax payable to the Collectivité
• Social contributions may also be due to the French government in the event of a capital gain, depending on your country of residence and the ownership structure of the property.
For the Buyer:
• Closing costs range from approximately 6% to 6.5% of the purchase price to cover notary fees and the transfer tax to the Collectivité.
• Translation fees may also apply if necessary.
